We take all reasonable precautions to safeguard your personal information from misuse, unauthorised access, modification or disclosure. When your information is no longer required we securely destroy it from our systems.

You may request access to the information we hold about you by contacting us. We may be required by law to retain your personal information after you have ceased your relationship with us.

We do not send personal information outside the country unless to do so is authorised by law.

What about sensitive information ?

Sensitive information can be about racial or ethnic origin, membership of a profession or trade, personal health or other personal information. We only collect, use or disclose sensitive information about you as is allowed by law.

We constantly review our policies and procedures to keep up-to-date with changes in law, technology and the needs of our guests and we may change this policy from time to time.

Terms & Conditions

These general terms and conditions (Terms and Conditions) apply for all services and deliveries and all reservations made for the “Hotel” “we” “our” or “us” herein referred to shall mean The Marsden Hotel Pty Limited (ACN 627 456 393 & ABN 43 627 456 393) or The Marsden Hotel, is agents, representatives, successors and assigns, and the “Customer” “You” or “Your” hereinafter referred to shall mean the person, client, company or its agents, representatives, successors and assigns to which the enquiry, bookings or engagement is addressed or made by.

Please read and refer to these Terms and Conditions carefully as these Terms and Conditions are deemed agreed to by the Customer and form part of the agreement or contract that applies to the website, provision of accommodation, enquires, bookings and generally relating to the Hotel, unless otherwise confirmed in writing by the Hotel.

ACCEPTANCE

By using and accessing the Hotel website (and any third party or participating websites) and/or making the Bookings it is deemed that the Customer accepts these terms and conditions. Further, the Customer must at all times adhere to and obey all Hotel policy and procedures including any applicable non smoking policy, no party policy or other policies issued from time to time, during its stay at or entry to the Hotel

You agree that you will pay to us the room rate for each day of your stay and any additional charges up until the time you advise us that you have departed from our Hotel.

BOOKINGS

All bookings made via participating websites, our website or with the Hotel directly are made subject to these Terms and Conditions and the Customer making the booking will be deemed to have accepted these Terms and Conditions on behalf of all persons who will be staying at the Hotel under the booking and further confirmed upon any payment is made in relation to the booking.

Bookings may also be governed by and subject to additional terms and conditions which are applied by us. These terms and conditions may relate to items such as payments, deposits and cancellations. If there is any inconsistency between any other booking or accommodation terms and conditions and these Terms and Conditions, than these Terms and Conditions will prevail.

Bookings are subject to the availability and applicable pricing at the time of the booking and some conditions and/exclusions may apply including but not limited to minimum stay requirements, blackout/special event periods.

Any quote given is an estimate only of price and the price will only be confirmed once a payment is made on the booking and you receive written advice from us that the payment has been received and the booking has been confirmed.

All prices are quoted in Australian dollars (unless otherwise specified) per room per night and are inclusive of GST. Prices are subject to availability and can change without notification due to fluctuations in charges and currency.

Any prices, fees, deposit amounts or charges which are specified or referred to in these Terms and Conditions are in AUD.

Any confirmed price is subject to change if:

a. a payment which is due on a booking is not received by us by the date the payment is due; or

b. there is a change in or imposition of a government charge, tax or levy which entitles or necessitates us changing the price of your booking; or

c. any details relating to your booking are amended, for example your dates of stay, your room type or the number of persons staying under your booking;

in which case this clause will apply.

The "from" rates displayed on the website are indicative rates only, are subject to availability and terms and conditions apply. Please select dates and check availability to get the most up to date pricing.

Children sleep free on existing bedding, within the maximum allowed guests per room. If a roll away / cot / sofa bed is required charges will apply.
Children the age of 18 years and under must be accompanied by an adult at time of check-in and stay at the Hotel.

CHECK- IN

When you check-in you may be asked to provide photographic identification, and completion of the requested registration card.

If you are unable to provide such identification your booking may be cancelled and you may be liable to pay us an amount equal to the full booking amount plus any other costs by us in connection with your reservation. Accordingly, any pre-payment made by you in relation to the booking will be forfeited to us under these Terms and Conditions.

Standard check-in time is 2.00 pm.

You agree that we may apply a charge if your required check-in time requires us to keep the room empty on the previous day.

You must advise us of any change in the number of persons using the room and agree to pay any additional charges for additional persons not included in the number stated at the time of registration.

CHECK -OUT

Check-out time is 11.00 am on the date shown for your departure unless we agree to another time.

Departure after that time may incur additional room charge.

You are and remain personally liable to pay the total amount due on departure unless prior settlement arrangements have been accepted by us. If the settlement arrangements have not been met within 30 days of departure you agree to pay the total amount due on the receipt of our invoice.

You must return the key and/or security card for the room at the time of your departure and agree to pay a charge for replacement of keys you lose or fail to return.

CANCELLATION POLICY

For any booking that requires payment on check-in to the hotel, booking must be cancelled by 2:00 pm, 24 hours before arrival to avoid cancellation fee.

Cancellations after this time or no-show are subject to a cancellation fee which will be charged to the credit card used to guarantee payment of your account. The cancellation fee is equal to the accommodation fee payable for 1 night of stay. A no-show is when you do not check-in on the night of your booking reservation.

Pre-paid bookings are subject to additional terms and condition which include no cancellation, no amendments or changes to the booking made by the Customer and non-refundable.

DEPOSIT POLICY

No deposit is required when booking a flexible rate online (i.e.. any booking that does not require payment at time of booking). Rates that contain restrictions must be paid at the time of making the reservation on The Marsden Hotel website. Please refer to individual rate terms prior to confirming your reservation.

PAYMENTS

A valid credit card MUST be presented on check-in to the hotel.

Payments may be made by credit card (as indicated for online bookings or as indicated as being accepted) or by cash or EFTPOS.

You agree to pay interim accounts when presented even though you may not have departed from our hotel.

You agree that any charges for services to you, not billed at the time of your checkout, may be added to your account for settlement as arranged or may be charged to the same credit card used to pay the account at the time of departure or to the credit card used to guarantee payment of your account.

Upon arrival at property Guests must provide valid Federal or State government issued photographic identification for security purposes. In addition, the Guest must also provide a credit card in the name of the photographic ID to secure the accommodation. A Credit Card pre-authorisation of up to $200 is required to cover incidental items including (but not limited to): mini bar, telephone calls, breakages/damages, excessive cleaning charges above the normal level of cleaning due to the room being left in an unacceptable state at the Hotel’s own discretion. This may also include an amount to cover a security bond / deposit for damages. The pre-authorised amount is set aside by the credit card company for a period of up to 10 working days (release times may vary, please check with the issuing financial institution). The pre-authorisation will affect your available funds balance or spending limit. For more information on this practice we suggest the cardholder contact their issuer. Once a pre-authorisation has been made, we cannot release, remove or lower the authorised amount, until we process the final account on departure. This is a restriction placed on us by the bank and cannot be negotiated. The Marsden Hotel reserve the right to pre-authorise all credit cards upon arrival. Please note this process validates the presented credit card and protects both the cardholder and merchant from increasing fraud incidents. Cash is not an acceptable form of bond when staying with The Marsden Hotel and a valid credit card will need to be presented on arrival.

SERVICES AND FACILITIES

Whilst care is taken to ensure that the description of our facilities and services is accurate, these are continually being changed, upgraded, and on occasion taken out of service. If any feature or facility is essential to you in choosing a particular property, it is your responsibility to confirm with the property prior to making your reservation that the feature or facility will be available during your stay.

To the extent permitted by law, The Marsden Hotel is not liable for omissions, errors or changes to the facilities and services at a property, whether temporary or permanent.

Accommodation facilities listed may not apply to all room types.

Our services and facilities at the hotel are to be used and enjoyed by Customers only and use of the services and facilities is at their own risk and liability, and must adhere to all policies relating to those services and facilities.

GENERAL

The Hotels reserves all of its rights and discretion to determine and process any Customers, as it sees fit and against its policy and procedures and any applicable licences, and at all times has the discretion to refuse entry or remove Customers or its guests or visitors in line with its Terms and Conditions and Hotel policy and procedures for the safe operation of the Hotel, its staff and overall operation of the Hotel.

The Terms and Conditions are governed by and will be construed in accordance with the laws of the New South Wales, Australia.

These Terms and Conditions may change from time to time, and will be updated or made available on request or on our website or at the Hotel.

Nothing in these terms and conditions affect any rights you may have and which by law cannot be excluded, including under the Competition and Consumer Act 2010 (Cth) and under State and Territory consumer protection legislation.

If part or all of any clause of these Terms and Conditions is voidable, invalid or unenforceable then it will be read down to the extent necessary to ensure that it is not voidable, invalid or unenforceable, but if that is not possible, it will be severed from these Terms and Conditions and the remaining provisions of these Terms and Conditions will continue to have full force and effect.

Third party services and products

The Marsden Hotel sometimes includes third party products or services in special packages and The Marsden Hotel is not liable under any circumstances for any failure by third party providers to provide products or services, nor for any error, alteration or change of any kind made by those third party providers following acceptance of a booking by them.

All third party coupons, vouchers, receipts and tickets are issued subject to the terms and conditions specified by those third parties.
The Marsden Hotel does not warrant the accuracy of any information, statements or representations made by third parties and is not liable for any act or omission, default or negligence of any third party provider.

RELEASES AND INDEMNITY

Any monies or other valuables, goods or vehicles that belong to you, brought in or on to the room, grounds or Hotel car park remain your responsibility and we are not responsible for their safekeeping.

To the extent permitted by law, you agree to release and hold harmless and indemnify The Marsden Hotel and its current and former officers, employees and agents against and from all expenses, costs, liabilities, claims, demands, actions, proceedings, damages, judgments and losses of any kind whatsoever (including consequential and economic losses, property loss/damage and damage for injury, including personal injury and death) arising out of, caused by, attributable to or resulting from your reservation, your use of any hotel services or facilities or your stay at The Marsden Hotel for any reason whatsoever.

You agree to indemnify The Marsden Hotel and its current and former officers, employees and agents for all expenses, costs, liabilities, demand, claims, actions, proceedings, damages, judgments and losses of any kind whatsoever (including consequential and economic losses, property loss/damage and damage for injury, including personal injury and death) incurred or suffered by The Marsden Hotel or its current or former officers, employees or agents arising out of, caused by, attributable to or resulting from your reservation, your use of any hotel services or facilities or your stay at The Marsden Hotel.

You agree that regardless of your length of stay there is no tenancy or other proprietary rights created under any laws.

We grant you a licence to stay in and/or use the facilities in our hotel and we reserve the right to terminate the licence at any time.

PRIVACY

We adhere to the National Privacy Principle relating to the collection, use and disclosure of personal information. All information collected from you is required either to meet the requirements of the State legislation regarding the maintenance of a guest register, for fire safety reasons, for billing purposes or for any other purpose stated in our Privacy Policy. We will not make this information available to any third party without your prior consent except where required by law or to enforce our collection of amounts owing by you. You must advise us if any details you’re your booking or any registration card are incorrect. All this data will be retained for the minimum length of time to comply with taxation and accounting requirements (usually seven years). Any personal data is accessible only by our authorised personnel. A charge will be levied if a copy of any records held, including paper registration card is required after six months from your departure from the Hotel. Copies (other than electronic data) are not available after two years. We will not knowingly permit any misuse of this data.

We may from time to time outsource the processing of certain functions of information to third parties or provide your information to our related entities and partners. Any personal information disclosed to our agents, related entities, partners, contractors and third-party service providers is only to the extent necessary for them to perform their agreed tasks and they are required to maintain the privacy of your information and keep such information confidential. We may transfer personal information we have collected about you to someone other than you in a foreign country, but only in accordance with and to the extent permitted by applicable privacy legislation. We will not disclose your personal information to overseas recipients without your consent.
